Terms and Conditions of the Summer Camp

The User using the services offered by this website, www.hedgieshuddledaycare.com, related to the summer camp, declares that they are aware of and fully accept the following terms and conditions.

The owner of the website www.hedgieshuddledaycare.com and the related services is Hedgie’s Huddle Daycare, Image Consultant di Cielo Camilla, VAT: 04288360243, Contrà Frasche del Gambero 38, 36100 Vicenza (“the Owner”).

Information About the Summer Camp

www.hedgieshuddledaycare.com is a website that promotes and markets services for a children’s summer camp, offering daily sessions of 8 hours, from 8:00 AM to 4:00 PM, Monday to Friday. Each week of the summer camp runs from Monday to Friday, for a total of 5 days, at a cost of 200 euros per week. The purchase of the service is weekly and valid only for the selected week.

Registration

To use the service, the User must register, providing truthful and complete information as required in the registration form, and must fully accept the privacy policy and these terms and conditions. The User is responsible for safeguarding their login credentials.

Health, Safety and Conduct

The safety of all children is the Owner’s first priority. By booking, the User accepts that:

The Owner may refuse admission, or immediately remove a child from the premises, whenever in the Owner’s reasonable judgement the child’s conduct or health condition poses a risk to the child’s own safety or health or to that of other children, staff or third parties. This includes, by way of example, aggressive or dangerous behaviour, symptoms of contagious illness, or any medical condition that the Owner is not equipped to manage safely.
The User must promptly inform the Owner of any allergy, medical condition, or special need of the child, and keep this information up to date.
Where a child is removed for the reasons set out in this clause, the Owner may also cancel any and all future days or weeks already booked for that child, without any obligation to provide a refund for the removed or cancelled sessions.

Owner’s Right to Cancel, Suspend, Terminate or Exclude

The Owner reserves the right, at its sole discretion and at any time, to:

suspend, cancel or refuse the service, for a single day, for one or more weeks, or entirely, for any individual child or User;
close or suspend a User’s account and cancel any future bookings already made;
exclude a child from the summer camp, including while a week is already in progress.

This right may be exercised with or without cause, with or without prior notice, and in particular (but not only) in the following cases: risk to the health or safety of the child or of others; conduct of the child or of the User (including parents, guardians or accompanying persons) that is disruptive, abusive or contrary to the camp rules; breach of these terms and conditions or of the camp regulations; failure to provide truthful information; or non-payment.

Where the Owner cancels or excludes for any of the reasons above (risk, conduct, breach, false information or non-payment), no refund is due for the cancelled or unused sessions. Where the Owner cancels for reasons of its own convenience and not attributable to the User or the child, the Owner will refund, on a pro-rata basis, the amount paid for sessions that can no longer be used, or will offer to reschedule them.

Cancellation and Termination by the User

A registered User may deactivate their account, request its deletion, or stop using the service at any time by contacting the Owner directly. Save for the specific exceptions set out in these terms, payments already made are non-refundable.

Service Price, Purchase Procedure and Payment Methods

The summer camp costs 200 euros per week for 5 days (Monday to Friday). Payment is made weekly, and the purchase is valid only for the selected week. Once purchased, the service is non-refundable, except in the specific cases expressly set out in these terms and conditions. www.hedgieshuddledaycare.com uses third-party tools for payment processing and does not come into contact with the payment data provided by the User.

Cancellation or Postponement of a Week by the Owner

The Owner reserves the right to cancel or postpone a week of the summer camp if fewer than 3 children are enrolled. In this case, the User will be notified of the change of date or of the cancellation of the week, and will be offered rescheduling or a refund of the amount paid for that week.

Execution of the Contract and Right of Withdrawal

The contract for the summer camp is considered concluded upon payment for the booked week. The User acknowledges that, as this is a service related to leisure activities provided on a specific date or period, the statutory right of withdrawal does not apply to the booked services.

Camp Regulations

By making a booking, the User accepts the regulations set by Hedgie’s Huddle Daycare for the summer camp. It is the User’s responsibility to review and understand these regulations before booking. The regulations are available at: https://hedgieshuddledaycare.com/regolamento.pdf. Breach of the regulations entitles the Owner to exercise the rights set out in the “Owner’s Right to Cancel, Suspend, Terminate or Exclude” clause above.

Service Interruption

In case of service interruption, Hedgie’s Huddle Daycare will make efforts to promptly inform Users and to provide alternative solutions, such as rescheduling the booked weeks.

Unauthorized Use

The User is not authorized to reproduce, duplicate, copy, sell, resell or exploit any portion of the summer camp services without the express permission of the Owner.

Privacy Policy

For information on the use of personal data, the User should refer to the privacy policy of www.hedgieshuddledaycare.com.

Copyright

All trademarks, whether figurative or word marks, and all other signs, trade names, service marks, logos, illustrations and images appearing on www.hedgieshuddledaycare.com are the exclusive property of the Owner or its licensors and are protected by trademark laws and applicable international treaties.

Limitation of Liability

To the maximum extent permitted by applicable law, the User releases and holds the Owner harmless from any liability for damages or claims of any kind, including direct or indirect damages, loss of data or replacement costs, arising from or in connection with this contract. Nothing in these terms limits any liability that cannot be excluded under mandatory law.

Amendments to the Terms and Conditions

The Owner reserves the right to modify these terms and conditions at any time. Changes will be published on the website www.hedgieshuddledaycare.com, and the User who continues to use the site tacitly accepts the new conditions.

Communications

All communications to the Owner must be sent using the contact information provided on the website www.hedgieshuddledaycare.com.

Severability

If any clause of these terms and conditions is deemed invalid, that clause will be removed and the remaining clauses will remain valid.

Applicable Law and Jurisdiction

All disputes related to these terms and conditions are subject to Italian law and to the exclusive jurisdiction of the court of Vicenza.

Informazioni sul Campo Estivo

www.hedgieshuddledaycare.com è un sito web che promuove e commercializza i servizi del campo estivo per bambini, con sessioni giornaliere da 8 ore, dalle ore 8 alle ore 16, dal lunedì al venerdì. Ogni settimana del campo estivo è valida dal lunedì al venerdì, per un totale di 5 giorni, con un costo di 200 euro settimanali. L’acquisto del servizio è settimanale e valido solo per la settimana scelta.

Registrazione

Per utilizzare il servizio, l’Utente deve registrarsi, fornendo in modo veritiero e completo tutti i dati richiesti nel modulo di registrazione, e accettare pienamente la privacy policy e i presenti termini e condizioni generali di contratto. L’Utente è responsabile della salvaguardia delle proprie credenziali di accesso.

Salute, Sicurezza e Comportamento

La sicurezza di tutti i bambini è la priorità del Proprietario. Effettuando la prenotazione, l’Utente accetta che:

Il Proprietario può rifiutare l’ammissione, o allontanare immediatamente un bambino dalla struttura, ogni volta che, a suo ragionevole giudizio, il comportamento o le condizioni di salute del bambino rappresentino un rischio per l’incolumità o la salute del bambino stesso o di altri bambini, del personale o di terzi. Rientrano, a titolo esemplificativo, comportamenti aggressivi o pericolosi, sintomi di malattia contagiosa, o qualsiasi condizione medica che il Proprietario non sia in grado di gestire in sicurezza.
L’Utente deve informare tempestivamente il Proprietario di qualsiasi allergia, condizione medica o esigenza particolare del bambino, mantenendo tali informazioni aggiornate.
Qualora un bambino venga allontanato per i motivi indicati in questa clausola, il Proprietario può altresì annullare tutti i giorni o le settimane futuri già prenotati per quel bambino, senza alcun obbligo di rimborso per le sessioni interrotte o annullate.

Diritto del Proprietario di Cancellare, Sospendere, Risolvere o Escludere

Il Proprietario si riserva il diritto, a propria esclusiva discrezione e in qualsiasi momento, di:

sospendere, cancellare o rifiutare il servizio, per un singolo giorno, per una o più settimane, o integralmente, per qualsiasi singolo bambino o Utente;
chiudere o sospendere l’account di un Utente e annullare eventuali prenotazioni future già effettuate;
escludere un bambino dal campo estivo, anche a settimana già in corso.

Tale diritto può essere esercitato con o senza giusta causa, con o senza preavviso, e in particolare (ma non solo) nei seguenti casi: rischio per la salute o la sicurezza del bambino o di altri; comportamento del bambino o dell’Utente (inclusi genitori, tutori o accompagnatori) molesto, offensivo o contrario al regolamento del campo; violazione dei presenti termini e condizioni o del regolamento del campo; mancata fornitura di informazioni veritiere; oppure mancato pagamento.

Qualora il Proprietario cancelli o escluda per uno dei motivi sopra indicati (rischio, comportamento, violazione, informazioni false o mancato pagamento), non è dovuto alcun rimborso per le sessioni annullate o non usufruite. Qualora il Proprietario cancelli per motivi di propria convenienza non imputabili all’Utente o al bambino, il Proprietario rimborserà, in misura proporzionale (pro-rata), l’importo pagato per le sessioni non più fruibili, oppure ne offrirà la riprogrammazione.

Cancellazione e Recesso da parte dell’Utente

L’Utente registrato può disattivare il proprio account, richiederne la cancellazione, o smettere di utilizzare il servizio in qualsiasi momento contattando direttamente il Proprietario. Salvo le specifiche eccezioni previste dai presenti termini, i pagamenti già effettuati non sono rimborsabili.

Prezzo del Servizio, Procedura di Acquisto e Modalità di Pagamento

Il campo estivo ha un costo di 200 euro a settimana per 5 giorni (dal lunedì al venerdì). Il pagamento avviene settimanalmente, quindi l’acquisto è valido solo per la settimana selezionata. Una volta acquistato, il servizio non è rimborsabile, salvo i casi specifici espressamente previsti dai presenti termini e condizioni. www.hedgieshuddledaycare.com utilizza strumenti di terze parti per l’elaborazione dei pagamenti e non viene a contatto con i dati di pagamento forniti dall’Utente.

Cancellazione o Posticipo di una Settimana da parte del Proprietario

Il Proprietario si riserva il diritto di cancellare o posticipare una settimana del campo estivo qualora non si raggiunga un minimo di 3 bambini iscritti. In tal caso, verrà notificato all’Utente il cambio di data o la cancellazione della settimana, e verrà offerta la riprogrammazione oppure il rimborso dell’importo pagato per quella settimana.

Esecuzione del Contratto e Diritto di Recesso

Il contratto relativo al campo estivo si considera concluso al momento dell’esecuzione del pagamento per la settimana prenotata. L’Utente è consapevole che, trattandosi di un servizio relativo ad attività di tempo libero da fornirsi in una data o in un periodo determinati, il diritto di recesso legale non si applica ai servizi prenotati.

Regolamento del Campo Estivo

Effettuando una prenotazione, l’Utente accetta il regolamento stabilito da Hedgie’s Huddle Daycare per il campo estivo. È responsabilità dell’Utente rivedere e comprendere tale regolamento prima di effettuare la prenotazione. Il regolamento è disponibile al seguente link: https://hedgieshuddledaycare.com/regolamento.pdf. La violazione del regolamento legittima il Proprietario a esercitare i diritti previsti dalla clausola “Diritto del Proprietario di Cancellare, Sospendere, Risolvere o Escludere” di cui sopra.

Interruzione del Servizio

In caso di interruzione del servizio, Hedgie’s Huddle Daycare si adopererà per informare tempestivamente gli Utenti e fornire soluzioni alternative, quali il recupero delle settimane prenotate.

Uso Non Autorizzato

L’Utente non è autorizzato a riprodurre, duplicare, copiare, vendere, rivendere o sfruttare qualsiasi porzione dei servizi del campo estivo senza il permesso espresso del Proprietario.

Politica sulla Privacy

Per informazioni sull’uso dei dati personali, l’Utente deve fare riferimento alla politica sulla privacy di www.hedgieshuddledaycare.com.

Tutti i marchi, figurativi o nominali, e tutti gli altri segni, nomi commerciali, marchi di servizio, illustrazioni, immagini e loghi che appaiono su www.hedgieshuddledaycare.com sono di proprietà esclusiva del Proprietario o dei suoi licenziatari e sono protetti dalle leggi in vigore sui marchi e dai relativi trattati internazionali.

Limitazioni di Responsabilità

Nella misura massima consentita dalla legge applicabile, l’Utente esonera e solleva il Proprietario da qualsiasi responsabilità per danni o reclami di qualsiasi tipo, inclusi danni diretti, indiretti, danni derivanti dalla perdita di dati o costi di sostituzione derivanti da o in relazione a questo contratto. Nulla nei presenti termini limita le responsabilità che non possono essere escluse ai sensi di norme imperative di legge.

Modifiche ai Termini e Condizioni

Il Proprietario si riserva il diritto di modificare questi termini e condizioni in qualsiasi momento. Le modifiche verranno pubblicate sul sito www.hedgieshuddledaycare.com, e l’Utente che continua a utilizzare il sito accetta tacitamente le nuove condizioni.

Comunicazioni

Tutte le comunicazioni al Proprietario devono essere inviate utilizzando le informazioni di contatto indicate sul sito www.hedgieshuddledaycare.com.

Nullità

Se una qualsiasi clausola di questi termini e condizioni dovesse risultare invalida, tale clausola sarà eliminata e le rimanenti clausole continueranno ad essere valide.

Legge Applicabile e Foro Competente

Tutte le controversie relative a questi termini e condizioni sono soggette alla legge italiana e alla giurisdizione esclusiva del tribunale di Vicenza.

Clausole vessatorie — doppia accettazione (art. 1341-1342 c.c.)

Ai sensi e per gli effetti degli artt. 1341 e 1342 c.c., l’Utente dichiara di aver letto e di approvare specificamente le seguenti clausole: “Salute, Sicurezza e Comportamento”; “Diritto del Proprietario di Cancellare, Sospendere, Risolvere o Escludere” (incluso il diritto di annullare senza rimborso e senza preavviso); “Cancellazione e Recesso da parte dell’Utente” (non rimborsabilità); “Esecuzione del Contratto e Diritto di Recesso”; “Limitazioni di Responsabilità”; “Modifiche ai Termini e Condizioni”; “Legge Applicabile e Foro Competente”.
